These Terms of Service ("Terms") govern your use of avoutpost.com (the "Site") and any orders placed with us. By accessing the Site or placing an order, you agree to these Terms.

About us

The Site is operated by TMC Ventures LLC, a North Carolina limited liability company, doing business as AV Outpost.

Eligibility

By placing an order, you represent that you are at least 18 years old and have the legal capacity to enter into a binding contract.

Products and pricing

We make every effort to display product details, pricing, and availability accurately. However:

  • Prices, specifications, and availability are subject to change without notice
  • We reserve the right to refuse or cancel any order, including orders that contain pricing errors, are placed by suspected fraudulent buyers, or cannot be fulfilled
  • Manufacturer specifications, dimensions, and weights are provided as published by the manufacturer and may vary slightly in actual product
  • Product images are representative; actual product appearance may vary

Orders and payment

  • All orders are subject to acceptance by AV Outpost. We confirm acceptance by sending an order confirmation email.
  • Payment is due at the time of order unless prior credit terms have been arranged in writing.
  • We accept major credit cards, debit cards, Shop Pay, Apple Pay, Google Pay, and ACH transfers (for verified business accounts).
  • Purchase orders may be accepted from verified business, government, and education customers — contact us to set up an account.
  • All sales are denominated in US Dollars (USD) and ship within the United States only.

Shipping and lead time

Lead times, shipping methods, freight surcharges, and delivery details are governed by our Shipping Policy. Lead time is generally 2–31 business days from order placement, with stock items typically shipping faster than built-to-order configurations.

Returns and warranty

Returns are governed by our Refund Policy, which limits returns to 14 days from delivery on stock items in original condition, with the customer responsible for return shipping unless the return is due to our error.

All products carry the full manufacturer warranty as published by the manufacturer.

Tax

Sales tax is calculated at checkout based on the shipping address and applicable state and local rates. Tax-exempt customers must email a valid resale certificate or tax-exempt documentation to sales@avoutpost.com before placing orders to have tax-exempt status applied.

Intellectual property

All content on the Site — text, images, logos, design, and code — is owned by TMC Ventures LLC, its licensors, or product manufacturers, and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from Site content without written permission.

Manufacturer trademarks (Chief, Wiremold, Middle Atlantic, C2G, On-Q, Vaddio, Luxul, Legrand AV, and others) are the property of their respective owners and are used here for product identification only.

Limitation of liability

To the maximum extent permitted by law, TMC Ventures LLC's total liability for any claim arising out of or relating to your use of the Site or any product purchased through the Site is limited to the amount you paid for the product giving rise to the claim.

We are not liable for:

  • Indirect, incidental, special, or consequential damages
  • Loss of profits, revenue, data, or business opportunities
  • Damages arising from improper installation, misuse, or use beyond the manufacturer's specifications
  • Damages caused by carrier delays, shipping damage (which is governed by carrier liability and our Refund Policy), or force majeure events

Indemnification

You agree to indemnify and hold harmless TMC Ventures LLC, its officers, members, employees, and affiliates from any claims, damages, or expenses arising from your misuse of the Site, violation of these Terms, or infringement of any third-party rights.

Governing law and dispute resolution

These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in New Hanover County, North Carolina, and you consent to the personal jurisdiction of those courts.

Changes to these Terms

We may revise these Terms at any time. The "Last updated" date reflects the most recent change. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
